General Description:

These Regulations impose health and safety requirements with respect to the provision and use of work equipment, and in doing so they revoke and re-enact previous regulations introduced in 1992.

In most cases, these regulations not only place duties on employers, but also on others (upto the extent of their control), including people having control of work equipment and people who use or supervise or manage its use or the way it is used. They also require that control systems of work equipment are chosen, that make due allowance for the failures, faults and constraints to be expected in the planned circumstances of use. More specifically, they require:

  • The inspection of work equipment in specified circumstances by a competent person.
  • The recording and keeping of the results.
  • That evidence of the last inspection accompany work equipment used outside the undertaking.

As far as mobile equipment is concerned (eg many forms of farm equipment), these regulations require that steps be taken to:

  • Ensure its suitability for carrying persons and its safety features.
  • Provide a means to minimise the risk to safety from its rolling over.
  • Ensure the safety of self-propelled work equipment and remote-controlled self propelled work equipment.
  • Ensure the safety of mobile work equipment powered by drive shafts.
