Ponds, Pools and Lochans

5.9 Planning issues

Pond creation may require planning permission where a significant change of land-use occurs. Consult your local authority planning department to confirm whether an

application for planning permission is likely to be required. Generally garden ponds can be created without planning permission. If you wish to create a very large pond which occupies a significant proportion of a garden, consult the local planning authority first.

Contact addresses for local planning authorities are available from COSLA.  If you are creating a large pond (holding more than 25,000 m3 water ) the Reservoirs Act applies. If you intend to stock with fish (except for garden ponds) contact SEERAD in the first instance (see Box 10).
