Land Reclamation (Waste Exemption 9A)

Land reclamation is normally for cases where the land is unsuitable to be used in its present state as it has been contaminated by the industries that have occupied the site in the past (contaminated land). The old contaminated materials will be removed and replaced by clean materials. Exemption 9A is not available for the disposal of waste at a site designed or adapted for final disposal of waste by landfill the purpose has to be reclamation not disposal. It is limited to a maximum of 2 metres depth of spreading. Spreading is not the same as infilling.
