General Description:

These regulations amend regulation 20 of, and insert regulation 20A into, the Special Waste Regulations 1996. Such regulations are related to the qualifications and experience needed for someone to be treated as technically competent within the meaning of section 74 of the Environmental Protection Act 1990.

Since the definition of special waste was altered on 1st September 1996, changes have been made to determination of 'technical competence' in dealing with such waste. Those persons whose competence in waste management is based upon the requirement of the Waste Management Licensing Regulations 1994 have, under this amendment, had their scope of competence widened to include any new special waste arising from the revised definition. Therefore, such persons are not required to make an application for a certificate of technical competence.
